GENERAL DESCRIPTIONThe Office of the Attorney General, a dynamic state agency with over 4,000 employees throughout the State of Texas, is hiring a Legal Assistant for the Bankruptcy Collections Division. The Bankruptcy Collections Division is the centralized collection authority for the State, charged with the responsibility to recover all debts, judgments, taxes, fees, fines, penalties, loans, and other obligations referred to the agency for collection. Division attorneys represent and protect the Stateand#8217;s monetary, regulatory, and policy interests in bankruptcy cases as they may appear.The OAG seeks a highly qualified legal assistant to join the Bankruptcy Regulatory Team. The Bankruptcy Regulatory Team represents state regulatory agencies such as the Texas Commission on Environmental Quality, the General Land Office, the Texas Railroad Commission, the Texas Health and Human Services Commission, and the Public Utility Commission as well as other OAG divisions including Consumer Protection, Healthcare Program Enforcement, and Environmental Protection in complex, high profile bankruptcy cases across the country. OAG employees enjoy excellent benefits (https://ers.texas.gov/Benefits-at-a-Glance) along with tremendous opportunities to do important work at a large, dynamic state agency making a positive difference in the lives of Texans.ESSENTIAL POSITION FUNCTIONSLegal Assistant IIIDrafts, prepares, reviews, and edits pleadings, motions, briefs, abstracts, legislative histories, petitions, summary judgments, rules, and correspondence in accordance with federal court and other applicable policies and rules
Researches and analyzes legal sources such as statutes, case law, administrative records, opinions, abstracts and rules and regulations; prepares memoranda on research findings
Prepares settlement and judgment documents; may interview witnesses and assists with background investigations; organizes documents
Prepares and coordinates service of subpoenas, notices of deposition and other legal documents to witnesses and parties to actions
Participates in coordinating, assembling and preparing evidence, exhibits, affidavits and other documents for use in legal proceedings
Participates in coordinating discovery, including the drafting, responding and calendaring of interrogatories, requests for production, requests for admissions and other requests for information in accordance with local, state, federal and agency rules and procedures
Participates in managing attorneysand#8217; case-loads including scheduling, prioritizing, investigating, preparing chronologies, fact summaries and filing
Schedules, attends, assists, and prepares attorneys for hearings, trials, agency meetings, appellate arguments, depositions, docket calls, administrative hearings or committee meetings
Reviews citations, quotations, footnotes, and references for accuracy; key cites cases
Reviews mail and screens calls for attorneys
Files pleadings with court
Assists with coordinating, assembling and preparing evidence, exhibits, affidavits and other documents for use in legal proceedings
Assists in all phases of trial preparation, including setting hearings/depositions/meetings, ordering demonstrative aides, coordinating discovery requests with client agencies, organizing trial notebooks and exhibits and preparing witnesses for trial
Assists attorneys and support staff with case management
Maintains calendar/docket, files, case openings and closings
Communicates with state agencies, court personnel or outside entities
Prepares Travel Requests and Travel Vouchers for attorneys and staff
Assists Office Manager as needed
Performs related work as assigned
Maintains relevant knowledge necessary to perform essential job functions
Attends work regularly in compliance with agreed-upon work schedule
Ensures security and confidentiality of sensitive and/or protected information
Complies with all agency policies and procedures, including those pertaining to ethics and integrityLegal Assistant IV and#8211; all above functions for Legal Assistant III plus:May supervise others
Conduct statistical, documentary, and investigatory research
Review and organize substantial discovery requests involving oversight reviews and relativity determination
May provide back up support to the Office Manager
Qualifications: MINIMUM QUALIFICATIONSLegal Assistant IIIEducation: Bachelor's degree from an accredited college or university; experience in the following (or closely related) fields may be substituted for the required education on a year-for-year basis: full-time legal assistant, legal secretary, or general office experience in a legal environment
Experience: One year full-time Legal Assistant supporting matters in federal courts
Knowledge of general office practices
Knowledge of legal documents
Knowledge of Westlaw, Lexis Nexis, or other legal research tools
Skill in handling multiple tasks, prioritizing, and meeting deadlines
Skill in effective oral and written communication
Skill in conducting effective research
Skill in exercising sound judgment and effective decision making
Ability to effectively manage attorneysand#8217; caseload
Ability to receive and respond positively to constructive feedback
Ability to work cooperatively with others in a professional office environment
Ability to provide excellent customer service
Ability to work more than 40 hours as needed and in compliance with the FLSA
Ability to lift and relocate 30 lbs.
Ability to travel (including overnight travel) up to 5%Legal Assistant IV and#8211; all above qualifications for Legal Assistant III plus:One additional year full-time Legal Assistant experiencePREFERRED QUALIFICATIONSEducation: Graduation from a course of study for legal assistants
